Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of IsItWired, including the IsItWired website, Chrome extension, related software, features, services, and content (collectively, the "Service").
By accessing or using the Service, creating an account, or purchasing a paid subscription, you agree to these Terms. If you do not agree, do not use the Service.
1. About IsItWired
IsItWired is a software-as-a-service product designed to help government contracting professionals review publicly available federal contracting information and assess indicators related to incumbent advantage, competitive positioning, and opportunity risk.
IsItWired may provide scores, summaries, indicators, historical information, analysis, recommendations, or other decision-support information.
IsItWired is not affiliated with, endorsed by, sponsored by, or operated by SAM.gov, the U.S. General Services Administration, or any other government agency.
2. No Guarantee of Contract Awards
IsItWired is an informational and decision-support tool only.
The Service does not:
- Guarantee that a government contract will or will not be awarded to any particular company.
- Guarantee that an opportunity is or is not competitive.
- Guarantee that an incumbent contractor will retain an award.
- Guarantee that a user will win, lose, qualify for, or successfully pursue any government contract.
- Replace professional capture, legal, proposal, procurement, financial, or business advice.
Any score, indicator, recommendation, or analysis should be considered alongside your own independent research and professional judgment.
You remain solely responsible for all bid, no-bid, capture, teaming, proposal, pricing, and business decisions.
3. Data Sources and Accuracy
IsItWired may use publicly available information from federal procurement and spending data sources, including SAM.gov, USASpending.gov, the Federal Procurement Data System (FPDS), and related public government data sources.
We aim to provide useful and accurate information, but government data may be delayed, incomplete, inconsistent, changed, or unavailable.
We do not guarantee that any information displayed through the Service is complete, current, accurate, or error-free.
Users should independently verify important information before making business decisions.
4. Accounts
Certain features require an IsItWired account.
You agree to:
- Provide accurate account information.
- Maintain control over access to your email account and sign-in credentials.
- Notify us if you believe your account has been accessed without authorization.
- Use only accounts that you are authorized to access.
You may not create multiple accounts primarily to bypass usage limits, free-tier restrictions, subscription limits, or other Service controls.
We may suspend or restrict accounts that appear to be used for fraud, abuse, circumvention, unauthorized access, or violation of these Terms.
5. Free Plan
IsItWired may offer a free plan that includes a limited number of Opportunity Checks per usage period.
Current free usage limits are displayed on the IsItWired website or within the Service.
Free-plan limits, features, or availability may change in the future.
Free usage has no cash value and may not be transferred between accounts.
6. Paid Subscriptions
Paid IsItWired subscriptions provide access to additional features and usage limits as described at the time of purchase.
Current subscription offerings may include monthly and annual billing options.
Subscriptions automatically renew unless canceled before the next renewal date.
Pricing, plan limits, and included features are displayed before purchase.
We may change future subscription pricing or features. Any pricing changes affecting an existing subscription will be communicated as required before taking effect.
7. Payments and Gumroad
Payments for IsItWired are processed by Gumroad, which acts as the Merchant of Record for applicable transactions.
When purchasing through Gumroad, your transaction is also governed by Gumroad's applicable terms of service, refund policy, payment terms, and privacy practices.
Gumroad may handle payment collection, applicable taxes, transaction receipts, refunds, chargebacks, and related payment administration.
8. Cancellation
You may cancel a paid subscription at any time through the available billing-management process.
Unless otherwise stated during checkout, cancellation generally takes effect at the end of your current paid billing period.
You will retain access to paid features through the end of the applicable paid subscription period unless your access is suspended or terminated for violation of these Terms.
Canceling prevents future renewal charges but does not automatically entitle you to a refund for amounts already paid.
9. Refunds
Refund requests are governed by the IsItWired Refund Policy and, where applicable, Gumroad's buyer and refund policies.
Nothing in these Terms limits any non-waivable rights you may have under applicable law.
10. Acceptable Use
You may use IsItWired only for lawful business purposes.
You may not:
- Attempt to reverse engineer, decompile, or improperly access the Service.
- Attempt to bypass account, usage, subscription, or security controls.
- Use automated methods to excessively query, scrape, overload, or interfere with the Service.
- Resell, sublicense, reproduce, or commercially redistribute IsItWired without authorization.
- Use the Service to violate procurement laws, regulations, third-party rights, or applicable law.
- Use information from IsItWired to make knowingly false, defamatory, or unsupported allegations regarding government agencies, contractors, procurement personnel, or competitors.
- Misrepresent IsItWired outputs as official government findings or determinations.
11. Meaning of "Wired"
The term "wired," as used by IsItWired, refers to indicators of potential incumbent advantage, competitive positioning, procurement history, or other opportunity-risk signals identified through available data and analysis.
A high Wired Score or similar indicator does not establish corruption, improper procurement activity, unlawful conduct, predetermined award outcomes, or wrongdoing by any government agency, contractor, or other party.
12. Intellectual Property
IsItWired and its software, scoring methodologies, interfaces, branding, designs, documentation, analysis formats, and proprietary technology are owned by or licensed to IsItWired and are protected by applicable intellectual-property laws.
Your subscription provides a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes.
No ownership rights are transferred to you.
13. User Content
If the Service allows you to save notes, opportunity information, company profiles, preferences, or other content, you retain ownership of content you provide.
You grant IsItWired the limited rights necessary to host, process, transmit, and display that content solely to provide and improve the Service.
You are responsible for ensuring that you have the right to submit any information you provide.
14. Artificial Intelligence Features
If IsItWired introduces artificial-intelligence-powered features, AI-generated summaries, recommendations, explanations, or assessments may contain errors or incomplete conclusions.
AI-generated content is provided for informational and decision-support purposes only and should be independently reviewed before being relied upon for business decisions.
15. Service Availability
We aim to keep IsItWired available and reliable, but we do not guarantee uninterrupted or error-free access.
The Service may occasionally be unavailable due to maintenance, third-party outages, software updates, government-data availability, security events, or circumstances outside our control.
Features may be modified, added, limited, or discontinued over time.
16. Third-Party Services
IsItWired may interact with or link to third-party websites, services, data providers, or platforms.
We are not responsible for third-party availability, accuracy, security, practices, content, or terms.
Use of third-party services is subject to their own applicable terms and policies.
17. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.
We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and any warranty arising from course of dealing or usage.
We do not warrant that the Service will identify every relevant opportunity, incumbent, risk factor, competitive condition, or procurement development.
18. Limitation of Liability
To the maximum extent permitted by law, IsItWired will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost contracts, lost opportunities, lost data, proposal costs, business interruption, or similar losses arising from use of or reliance on the Service.
To the maximum extent permitted by law, IsItWired's aggregate liability arising from the Service will not exceed the amount you paid for the Service during the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain liability limitations, so some of these provisions may not apply to you.
19. Suspension and Termination
We may suspend or terminate access if we reasonably believe that:
- You violated these Terms.
- Your use creates security, legal, technical, or fraud risk.
- Payment remains unresolved.
- You are attempting to circumvent Service restrictions.
- Continued access could harm IsItWired, its users, third parties, or the Service.
You may stop using the Service at any time.
20. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we will provide reasonable notice through the website, Service, or account email where appropriate.
Continued use of the Service after updated Terms take effect constitutes acceptance of those revised Terms.
21. Governing Law
These Terms are governed by the laws applicable to the location from which IsItWired is operated, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
